Special Terms MY·ONE – Day Charter and 4-Hour Tour

General (applies to A and B)

1. Scope. These Special Terms apply to the day charter and the 4-hour tour on the yacht MY·ONE from Marina Portus Karalis, Cagliari (Sardinia). In all other respects, the General Charter Terms & Conditions for MY·ONE apply, in particular regarding force majeure (XV), data protection (XVI), governing law and jurisdiction (XVII) and the final provisions (XVIII). In the event of any conflict, these Special Terms prevail. Contract language is English; in the event of translations, the English version shall prevail.

2. Skipper. A professional skipper is always on board and in command of the yacht. The skipper decides on the route, anchorages, swimming and all matters of safety. The skipper's instructions must be followed. Anyone who endangers safety on board may be excluded from the remainder of the trip; in that case no refund is made.

3. Prices. All prices are final prices in euros including statutory VAT.

4. No right of withdrawal. As these are leisure services for a specific date, there is no statutory right of withdrawal. The cancellation terms below apply.

5. Weather. The skipper decides on site whether the trip can take place and adjusts times or the route where necessary. If we cancel the trip before departure due to weather or for safety reasons, you will receive, at your choice, an alternative date or a full refund of the amount paid, including extras. If the trip has to be ended early during the trip for these reasons, we refund the share of the unused time if less than half of the booked time has elapsed; after that, no refund is made.

6. Swimming and equipment. Swimming, snorkelling and the use of SUPs are permitted only with the skipper's permission and at your own risk within the limits of the law.

7. Alcohol. Only guests aged 18 or over may bring and drink alcoholic beverages. The skipper may limit or prohibit the consumption of alcohol. No drinks are sold on board.

8. Children. Minors may only take part when accompanied by a parent, guardian or authorised adult who supervises them throughout the trip. The duty of supervision lies solely with this accompanying person; the skipper and crew do not supervise children, including while swimming, snorkelling or using SUPs. Life jackets for children are on board. Children who cannot swim confidently must wear a life jacket on deck and in the water; the accompanying person is responsible for ensuring this. The skipper's responsibility for the safety of the yacht and the skipper's instructions under clause 2 remain unaffected.

9. Health and mobility. The trip is not suitable for people with reduced mobility, wheelchair users or people who are prone to seasickness. Getting into and out of the water is via a swim ladder. Please let us know before booking if you have any limitations.

10. Guests' liability. Guests are liable in accordance with statutory provisions for damage to the yacht and its equipment that they culpably cause. No security deposit is charged.

11. Our liability. We are liable in accordance with statutory provisions. In cases of slight negligence, our liability is limited to the price of the booked service; this does not apply to injury to life, body or health or to mandatory consumer rights. We are liable for personal belongings brought on board only in case of fault.

12. Not permitted on board: red wine, shoes, pets, smoking (e-cigarettes and vapes are permitted). Cold snacks and drinks may be brought on board.

A. Day charter (private)

1. Service. Private use of MY·ONE with skipper for your group only, within the time window between 10:00 and 19:00, for a minimum of 4 and a maximum of 9 hours. The hourly rate applies to the group of up to 10 people; up to 12 people on request. Included: skipper, fuel, snorkelling sets, SUPs, use of one cabin with bathroom.

2. Extras. The lunch box and drinks box can be booked up to 48 hours before the trip. Stewardess service subject to availability.

3. Payment. The full price is due upon booking.

4. Cancellation by you.

• up to 14 days before the trip: free of charge, you receive a full refund
• 13 to 4 days before the trip: you receive a refund of half the price
• 3 days or less before the trip, or if you do not show up: no refund

The date on which we receive your message is decisive. You may prove that we incurred no loss or a lower loss. If we manage to re-let the date, we will credit the proceeds.

5. Punctuality. The booked time starts at the agreed departure time, even if you arrive later. An extension is possible only subject to availability and is charged per commenced hour at the booked hourly rate.

B. 4-hour tour (individual seats)

1. Service. Shared trip with other guests, 10:00–14:00 or 15:00–19:00, from 1 May to 30 September 2027. A maximum of 10 guests per departure. Included: skipper, fuel, flybridge, shaded and sunbathing areas, trampoline nets, swim ladder, SUPs, snorkelling equipment and pool noodles.

2. Prices and age groups. Adults (18 and over) €89, teenagers (13–17) €79, children (3–12) €59, infants (0–2) free of charge. The age on the day of the trip is decisive. Every person occupies a seat, including infants. Each booking must include at least one adult. Proof of age may be requested before departure for the teenager, child and infant rates. If the stated age is incorrect, the difference to the correct price must be paid before departure; otherwise the person concerned may be refused participation without a refund.

3. Minimum number of participants. A departure takes place with 4 or more paying guests; infants (0–2) do not count towards this minimum but occupy a seat for the maximum of 10. The first booking for a departure must include at least 4 paying guests. If cancellations reduce the number of paying guests to fewer than 4, we may cancel the departure up to 24 hours before departure; you will then receive, at your choice, an alternative date or a full refund.

4. Payment. The full price is due upon booking.

5. Cancellation by you. Up to 48 hours before departure you can cancel free of charge and receive a full refund. For later cancellations, or if you do not show up, we do not refund the price. You may also cancel individual seats.

6. Meeting point and punctuality. Please be at the meeting point in Marina Portus Karalis 15 minutes before departure. The yacht leaves on time so that all guests get their full time. Anyone who is not there on time is treated as a no-show.

7. Please bring: ID card or passport, swimwear and towel, sunglasses, sun hat and sunscreen, comfortable clothing.
